How does privacy work for minors?
Minors (anyone under 18) who use design3 have a slightly different experience with privacy than adults. Both adults and minors have publicly available information (name, profile picture, gender, current city, networks, Friend List, Page) that will appear when people navigate to their profile and may be accessed by applications that they use. Adults and minors both appear in search results on design3.
However, the "Everyone" setting works differently for minors than it does for adults. When minors set information like photos or status updates to be visible to "Everyone," that information is actually only visible to their friends, friends of friends, and people in any school or work networks they have joined. Additionally, minors do not have public search listings created for them, so they do not appear in outside search engines until they have turned 18.
What kind of privacy settings do you offer?
Every design3 user has the ability to customize his or her privacy settings. Users are able to limit who can view their profile (e.g., everyone, only their friends, etc.) and to choose who can see specific parts of their profile (e.g., their contact information, their personal favorites, their work history, etc.).
Privacy settings can be accessed through the "Privacy Settings" link from the "Settings" drop-down available at the top right side of any page on the site.
How should I help my child use this site wisely?
The best thing to do is to talk to your children and teach them about Internet safety. Remind them to:
- Never share their password with anyone
- Understand their privacy settings
- Report people that violate our Statement of Rights and Responsibilities
- Block anyone that might be sending unwanted content
How do I report cyberbullying?
We want design3 to remain an environment where people can connect and share comfortably. Cyberbullying is defined as the use of any new technology to harass or intimidate someone and is considered to be abusive behavior from minor to minor, while cyberharassment typically involves adults. There are steps you can take to prevent this kind of behavior if it occurs.
Accept Friend Requests Safely
In order to prevent harassment from strangers, be careful to accept friend requests only from people you know in real life. Also, remember to report any messages or profiles that look suspicious. design3 is based on a real-name culture, and fake profiles are regularly disabled when they're reported to us. Please also keep in mind that only confirmed friends can post to your Wall or contact you via design3 Chat, so if you're worried that someone will make inappropriate posts or send offensive messages, just ignore that person's friend request.
Use the "Block" Feature to Stop Abusive Behavior
A block prevents specific people from viewing your profile. When you block people, any ties you currently have with them will be broken, and these people won't be able to contact you through design3. If you receive inappropriate or abusive communication, you can block the person by listing his or her name in the "Block People" box at the bottom of your Privacy Settings page. You can visit this page at any time by hovering your mouse over the "Settings" link at the top of any design3 page and selecting the "Privacy Settings" option from the drop-down menu that appears.
Report Abusive Behavior Directly to design3
The most efficient way to report abuse is to do it in the same place it occurs on design3. For example, if you receive a harassing message in your Inbox, you can report the message by clicking on the "Report" link next to the sender's name as you are reading the message. If you receive a harassing message from a person who is a design3 friend of yours, you should remove the person as a friend and report the message. Reporting the message as harassing will automatically add this person to your Block list. You can also use the "Report/Block person" link that appears at the bottom of the abusive user's profile. If you learn that someone is continuing to make abusive comments about you even after you've blocked them, you can ask a friend to report that person on your behalf. Reports are confidential and the user being reported does not know that they have been reported. After a report is submitted, we will investigate the issue and make a determination as to whether or not the content should remain on the site based on our Terms of Use. A design3 administrator looks into each report thoroughly in order to decide the appropriate course of action.
Restrict Privacy Settings
To restrict the amount of information that potential bullies may have access to, customize your privacy settings so that certain people can't access information like your Wall, photos, or profile. You can also change your privacy settings if you are uncomfortable being found in searches or having your profile viewed publicly. Privacy on design3 is controlled primarily from the Privacy Settings page.
Respond to Abusers in the Right Way
Cyberbullies often seek a reaction from the people they harass. When they fail to get one, they often give up gradually. Rather than responding to a bully via Inbox, a Wall post, or design3 Chat, you can delete offensive posts from your Wall or messages from your Inbox and then use the "Block" or "Report" functions to resolve the issue safely. To delete an offensive Wall post, hover over the post in question, click the "Remove" button that appears, and select "Delete" in the dialogue box. To delete a message from Inbox, simply click the "Delete" button at the top of the message. Only confirmed friends can post to your Wall or send you a message through Chat. If you are receiving posts and Chat messages you don't like, you should consider removing the sender from your friends list.

How can I gain access to or delete my child's account if they are 13 years or older?
We appreciate your concern for your child's use of our website, but unfortunately we cannot give you access to the account or take any action on the account at your request. We are generally forbidden by privacy laws against giving unauthorized access to someone who is not an account holder. Please note that all users ages 13 and older are considered authorized account holders and are included in the scope of this policy.
We encourage parents to exercise any discretion they can on their own computers and in overseeing their kids' internet use. If you are a parent, you might also consider using software tools on your own computer in order to do so. Please do a search for computer-based Internet control technology on your preferred search engine to discover options that you may wish to pursue.
Please also talk to your kids, educate them about internet safety, and ask them to use our extensive privacy settings.
What if my child sees inappropriate content or offensive material on the site?
design3 takes the safety of its users very seriously and makes a significant effort to take down any objectionable material that may be posted on the site. We encourage users to report offensive profiles, messages, groups, events, shares, notes and photos. Reported items are then reviewed by design3 administrators and removed if deemed in violation of our Statement of Rights and Responsibilities. Users also have the option of "blocking" other users, which will ensure that they are unable to find them in a search, view their profile or send them a message.
What happens if my child creates an account and they are under 13 years old?
design3 requires its users to be at least 13 years old before they can create an account. Providing false information to create an account is a violation of our Statement of Rights and Responsibilities.
Applicable laws may give parents the right to access personal information their child has provided before design3 follows its policy of promptly deleting such accounts. If you are aware of your underage child having an account on design3, you can show them how to delete their account by having them log into their profile and following this link.
If you would like to report an underage user (under 13 years of age), please do so here. We will promptly delete the account of any underage user that is reported to us through this form.
Alternatively, you can submit a request to design3 here. Please be aware that you will be required to submit a notarized statement declaring your rights as a parent or guardian immediately upon using this form.
How do I search for friends by location?
You can search for friends from a specific location by going to the Friends page and selecting the Browse filter. Then, select "City" in the drop-down menu and choose from the full list of cities in the next drop-down.

Advertising Philosophy
At design3, we believe that every part of our site, including the ads, should contribute to and be consistent with the overall user experience. Thus, we are committed to protecting our user experience by keeping the site clean, consistent, and free from intrusive advertising. We believe that we can help transform existing advertising into messages which are tailored to the individual user based on how their friends interact and affiliate with the brands, music artists, and businesses they care about.
Advertising Guidelines
The following guidelines apply to all ads appearing on design3, including ads within canvas pages of design3 platform applications. In addition, all advertising on design3 must comply with the Privacy Policy and Statement of Rights and Responsibilities. design3 reserves the right to reject or remove advertising that we deem contrary to our ad philosophy. These guidelines are subject to change at any time and design3 may waive any of these guidelines at its discretion.
- 1. Accounts
- Advertisers cannot create or manage multiple design3 accounts for advertising purposes unless given permission by design3 to do so.
- Advertisers cannot programmatically automate the creation of accounts or ads unless given permission by design3 to do so.
- 2. Landing pages / Destination URLs
. Ads that contain a URL or domain in the body must link to that same URL or domain.
- Ads must send users to the same landing page when the ad is clicked.
- Landing pages cannot generate a pop-up (including "pop-overs" and "pop-unders") when a user enters or leaves the page.
- Landing pages cannot use "fake" close behavior (ie. when a user clicks the 'close' icon on the page, the page should close down and no other behavior should result).
- Landing pages cannot utilize "mouse trapping" whereby the advertiser does not allow users to use their browser "back button" and traps them on their site and/or present any other unexpected behavior (for example: navigation to another ad or page).
- Ads cannot require viewers to click on the ad to submit Personally Identifiable Information (such as name, date of birth, phone numbers, social security number, physical addresses, or email addresses) on the landing page or in the ad, except to enable an ecommerce transaction and where the ad and landing page clearly indicate that a product is being sold.
- 3. design3 references
. The following conditions apply to all ads that have a design3 Page, application, event, group, or Connect site as its destination, except as otherwise specifically permitted to those subject to the Branding and Promotion section of the platform Policies:
- i. Ads may make limited references to "design3" in its title, body, or image for the purposes of clarifying the destination of the ad;
- ii. Ads cannot imply any endorsement of the product, service, or ad destination by design3.
- All other ads, destination ads, and landing pages must adhere to the following restrictions:
. Ads cannot mention or refer to design3, its site or its brand in any manner, including in the title, body, image, or destination URLs;
- i. Ads cannot use design3 logos, trademarks, or site terminology (including but not limited to design3, The design3, d3, and other company graphics, logos, designs, or icons);
- ii. design3 site features cannot be emulated.
- 4. Ad Copy and Image Content
. Ads must directly relate to the content on the landing page.
- Ads must clearly represent the company, product, or brand that is being advertised.
- Ads cannot insult, harass, or threaten a user.
- Ads cannot contain audio that plays automatically, without a user's interaction.
- 5. Prohibited Content
. Ads must not be false, misleading, fraudulent, or deceptive.
- Ads cannot contain, facilitate, promote, or reference the following:
. Offensive, profane, vulgar, obscene or inappropriate language;
- i. Obscene, defamatory, libelous, slanderous and/or unlawful content;
- ii. Tobacco products;
- iii. Ammunition, firearms, paintball guns, bb guns, or weapons of any kind;
- iv. Gambling, including without limitation, any online casino, sports books, bingo, or poker without authorization from design3;
- v. Scams, illegal activity, pyramid schemes, or chain letters;
- vi. Contests and sweepstakes unless given permission by design3 to do so; if permission is given, you are subject to design3's Promotions Guidelines;
- vii. Get rich quick and other money making opportunities that offer compensation for little or no investment, including money making schemes positioned as alternatives to part-time or full-time employment;
- viii. Adult content, including nudity, sexual terms and/or images of people in positions or activities that are excessively suggestive or sexual, or provocative images in violation of community standards;
- ix. Adult friend finders or dating sites with a sexual emphasis;
- x. Adult toys, videos, or other adult products;
- xi. Uncertified pharmaceutical products;
- xii. Spy cams or illegal surveillance equipment;
- xiii. Web-based non-accredited colleges that offer degrees;
- xiv. Inflammatory religious content;
- xv. Politically religious agendas and/or any known associations with hate, criminal and/or terrorist activities;
- xvi. Content that exploits political agendas or uses "hot button" issues for commercial use regardless of whether the advertiser has a political agenda;
- Hate speech, whether directed at an individual or a group, and whether based upon the race, sex, creed, national origin, religious affiliation, marital status, sexual orientation, gender identity, or language of such individual or group;
- Content that advocates against any organization, person, or group of people, with the exception of candidates running for public office;
- xix. Content that depicts a health condition in a derogatory or inflammatory way or misrepresents a health condition in any way.
- 6. Data and Privacy
. You may not give data you receive from us to any third party, including ad networks.
- Unless authorized by us, your ads may not display user data -- such as users' names or profile photos -- whether that data was obtained from design3 or otherwise.
- You may not use user data you receive from us or collect through running an ad, including information you derive from your targeting criteria, for any purpose off of design3, without user consent.
- 7. Targeting
. Any targeting of ads based on a user attribute, such as age, gender, location, or interest, must be directly relevant to the offer, and cannot be done by a method inconsistent with privacy and data policies.
- Ads with adult themes, including contraception, sex education, and health conditions must be targeted to individuals at least 18 years old. Platform ads should do this via Demographic Restrictions, not by obtaining user data.
- Ads for dating sites, services, or related content must follow these targeting criteria (does not apply to ads on design3 platform):
. the Relationship Status targeting parameter must be utilized and set to Single;
- i. the Sex targeting parameter must be utilized and a single value of Male or Female must be selected;
- ii. the Age targeting parameter must be utilized and the age range selected must start at least at 18 years old;
- iii. the Interested In targeting parameter must be utilized and a single value of either Men or Women must be selected.
- 8. Prices, discounts, and free offers
. Ads cannot be deceptive or fraudulent about any offer made.
- If an ad includes a price, discount, or 'free' offer,
. the destination URL for the ad must link to a page that clearly and accurately offers the exact deal the ad has displayed;
- i. the ad must clearly state what action or set of actions is required to qualify for the offer.
- 9. Subscription Services
. The advertisement of Subscription Services must comply with the conditions noted below and as determined by design3 in its sole discretion. "Subscription Services" may include sites that promote downloading ringtones, wallpaper, or text messages for predictions, love life advice, news, personality quizzes, or other entertainment services or any site that induces a user to sign up for recurring billing of a product or service.
. The ad must clearly state what action or set of actions is required to qualify for the offer. If the user must subscribe to a service, the service and offer requirements must both be stated in the ad (e.g. "Subscription required").
- i. The promoted website must clearly and accurately display the price and billing interval (such as per week or once per month) on the landing page as well as any page that prompts a user for Personally Identifiable Information (such as name, date of birth, phone number, social security number, physical addresses, or email addresses) or billing information (including, but not limited to, mobile phone number or credit card number).
- ii. If users sign up for the service by transmitting a code by text message, the price and billing interval must be clearly and prominently displayed beside the code.
- iii. If the service is a subscription, the website must provide a prominent opt-in checkbox or other clear mechanism indicating that the user knowingly accepts the price and subscription service. This should be on the first page where the user enters personal data, and the user should not be able to proceed without opting in.
- iv. All of the foregoing items should be located in a prominent place on your webpage, as determined by design3 in its sole discretion, and should be easy to find, read, and understand.
- 10. Ads for Alcoholic Beverages
. Ads must be targeted to people 21 years old or older in the US, 19 years old or older in Canada, 18 years old or older in the UK, and 21 years old or older everywhere else. All design3 Pages viewer restrictions must be set at 21+ regardless of the country they are in or targeted to. In the case where a user's age cannot be determined, the ad cannot be displayed to the user in question.
- Ads cannot include content that might appeal to (or mislead) minors by implying that the consumption of alcoholic beverages is fashionable or the accepted course of behavior for those who are underage.
- Ads cannot include or target any person under the legal drinking age in the region the ad appears, or be suggestive of the presence of those who are underaged
- Ads cannot portray or promote intoxication.
- Ads cannot induce people to consume alcohol in excess, make references to the intoxicating effects of alcohol, depict activities that encourage excessive consumption or that encourage drinking at a rapid rate, or suggest the strength of the alcoholic beverage being advertised.
- Ads cannot promote any giveaways as a reward for purchasing the alcoholic product.
- It is recommended that the ad creative contain text that promotes drinking responsibly, eg. "Drink Responsibly" or "Drink Smart".
- 11. Copyrights and trademarks
. Ads cannot include any content that infringes upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary right.
- The advertiser must have intellectual property rights to the creative and be permitted to display such creative as advertising on the design3 Site.
- 12. Spam
. Ads cannot contain, facilitate or promote 'spam' or other advertising or marketing content that violates applicable laws, regulations or industry standards.
- 13. Incentives
. Ads cannot offer incentives to viewers for clicking on the ad, for submitting Personally Identifiable Information (such as name, date of birth, phone number, social security number, physical addresses, or email addresses), or for performing any other tasks.
- 14. Downloads
. Ads cannot contain or link, whether directly or indirectly, to a site that contains spyware/malware downloads, whether initiated automatically or manually by the user, or other auto-initiated downloads.
- Ads that link to a site that facilitates or promotes toolbars or other non-malicious user-initiated downloads must clearly state the action the user must take to utilize the service (e.g. "Download required").
- Ads cannot contain or link to a site that facilitates or promotes:
. Collection of demographic and usage information from a user's computer without the user's express consent;
- i. Collection or request of design3 usernames or passwords from any user;
- ii. Proxying design3 usernames or passwords for the purpose of automating logins to the design3 site;
- iii. Any software that (i) "sneaks" onto a user's system and performs activities hidden to the user, (ii) may alter, harm, disable or replace any hardware or software installed on user's computer without express permission from the user, (iii) is bundled as a hidden component of other software whether free or for fee, (iv) automatically downloads without design3's express prior approval, (v) presents any download dialog boxes without a user's express action, or (vi) may violate or infringe upon the intellectual property rights of any third party, including copyright, trademark, patent or any other proprietary right.
- 15. Grammar, sentence structure, spelling, and spacing
- Ad text must be grammatically correct and contain proper sentence structure.
- Ad text must be in complete sentences.
- Ads cannot include excessive repetition (such as "buy, buy, buy").
- Ads must use correct spelling.
- Ad text must include grammatically correct spacing.
- Ad text must be grammatically correct and contain proper sentence structure.
16. Capitalization
. Ads must use proper, grammatically correct capitalization (such as capitalizing the first letter of all proper nouns and capitalizing the title of the ad).
- Ads cannot include excessive capitalization (such as "FREE") or incorrect capitalization (such as capitalizing the first letter of every word in a sentence).
- Acronyms may be capitalized.
17. Punctuation
. Ads must include logical, correct punctuation.
- Ads cannot contain repeated and unnecessary punctuation (such as "Buy now!!!").
- All complete sentences (including if the ad title is a complete sentence) must end with a single punctuation mark. Sentences cannot end with ellipses, dashes, etc.
- Exclamation points cannot be used in the title of any ad.
18. Symbols
. The use of all symbols, numbers, or letters must adhere to the true meaning of the symbol.
- Ads cannot contain repeated and unnecessary symbols.
- Symbols cannot be used for the following:
- i. To substitute for letters (e.g. "$ave" instead of "save");
- ii. To substitute for entire words (e.g. "&" instead of "and" or "$" instead of "cash/dollars/money");
- iii. As unnecessary abbreviations to shorten character count (e.g. "w/" instead of "with" or "@" instead of "at").
- Symbols may be used for the following:
. If the symbol is part of the product or brand name;
- i. If the $ symbol is paired with a dollar amount (e.g. "Save $100 today");
- ii. If the # symbol is used for comparative phrases (e.g. "Voted the #1 site by NY Times").

1. NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
2. ELIGIBILITY: design3's Dev-ember giveaway is open to all design3 members with free or paid memberships. Odds of winning depend upon the number of eligible community members for each drawing. Limit one prize per person/email address.
3. GIVEAWAY TIMING/DESCRIPTION: The giveaways will take place on week days throughout the month of December, starting Dec. 1st and ending on Dec. 31st between 8am and 5pm PST. The drawings will be conducted randomly - all design3 members (free and paid) are automatically entered into the drawing.

5. design3 Promotions Guidelines

These Promotions Guidelines govern the publicizing or administering of any sweepstakes, giveaways, contest, competition or other similar offering (each, a "promotion") on design3 by you. For clarity, a "sweepstakes" or "giveaway" is a promotion that includes a prize and a winner selected on the basis of chance. A "contest" or "competition" is a promotion that includes a prize and a winner determined on the basis of skill (i.e., through judging based on specific criteria). Publicizing a promotion on design3 means promoting, advertising or referencing a promotion in any way on design3 or using any part of the design3 platform. This may include, for example, in design3 advertising inventory, on a design3 Page, or through a status update. Administering a promotion on design3 means operating any element of the promotion on design3 or using any part of the design3 platform. This may include, for example, collecting submissions or entries, conducting the drawing, judging winning entries, or notifying winners. By publicizing or administering the promotion in any way on design3 or using any part of the design3 platform, you agree to these Promotions Guidelines.
Section 1. General
1.1 Without limiting any provision set forth herein, you acknowledge and agree that you are responsible for ensuring that any promotion and the administration, advertising, publicizing and fulfillment of such promotion complies with all applicable federal, state, provincial and local laws and applicable regulatory and industry rules, regulations and guidelines.
1.2 You are fully and solely responsible and liable for your promotion, including, without limitation, every element of publicizing or administering a promotion on design3 or using any part of the design3 platform, even if design3 authorizes a promotion to be publicized or administered on design3 or using any part of the design3 platform.
1.3 You will not in any way use our name, trademarks, trade names, copyrights, or any other of our intellectual property in the rules or any other materials relating to the promotion, without express written consent.
1.4 The promotion and any publicity associated with the promotion must be true and accurate, and cannot mislead, deceive or otherwise misrepresent the prize or any other aspect of the promotion.
Section 2. Prohibitions
You may not publicize or administer a promotion on design3 if:
2.1 The promotion is open or marketed to individuals who are under the age of 18;
2.2 The promotion is open to individuals who reside in a country embargoed by the United States;
2.4 The promotion’s objective is to promote any of the following product categories: gambling, tobacco, firearms, prescription drugs, or gasoline;
2.5 The prize or any part of the prize includes alcohol, tobacco, dairy, firearms, or prescription drugs; or
2.6 The promotion is a sweepstakes that conditions entry upon the purchase of a product, completion of a lengthy task, or other form of consideration.
Section 3. Administering a Promotion through the design3 platform
You may not administer any promotion through design3, except that you may administer a promotion through the design3 platform with our prior written approval. Such written approval may be obtained only through an account representative at design3. If you are already working with an account representative, please contact that representative to begin the approval process. 3.1 You will only administer the promotion through an application on the design3 platform, as directed by us.
3.2 You will only allow users to enter the promotion in the following locations on design3:
3.2.1 On the canvas Page of an application on the design3 platform.
3.2.2 On an application box in a tab on a design3 Page.
3.3 You will include the following language in a clear and conspicuous manner adjacent to any promotion entry field: "This promotion is in no way sponsored, endorsed or administered by, or associated with, design3. You understand that you are providing your information to [recipient(s) of information] and not to design3. The information you provide will only be used for [disclose any way that you plan to use the user's information]."
3.4 You will not mention “design3” in the promotion's rules except in the following ways: (i) "You can enter the Promotion through the [application name] application on the design3 platform. You can also find the application on the [tab name] tab on the [Page name] Page on design3."; (ii) to fulfill your obligations under Section 3.7.
3.5 You will designate an individual to act as a primary contact to address any communications from us with respect to the promotion.
3.6 You must submit materials for any promotion you plan on administering through the design3 platform to your account representative for our review and approval at least 7 days prior to the start date of such promotion. Promotions not approved in writing within such time period will be deemed unapproved.
3.7 You will include the following provisions within your official rules for the promotion:
3.7.1 Acknowledgement that the promotion is in no way sponsored, endorsed or administered by, or associated with, design3.
3.7.2 Complete release for us from each entrant or participant.
3.7.3 Any questions, comments or complaints regarding the promotion will be directed to you, not us.
Section 4. Publicizing a Promotion on design3
You do not need our prior written approval if you are publicizing a promotion that is administered completely off of design3. However, we may remove any materials relating to the promotion or disable your Page or account if we determine that you violate these Promotions Guidelines, the Statement of Rights and Responsibilities or any other of our policies. If you publicize a promotion in any way on design3, in addition to the other terms and conditions contained in these Promotion Guidelines, without limiting your other obligations you agree to the following:
4.1 You will not directly or indirectly indicate that design3 is a sponsor or administrator of the promotion or mention design3 in any way in the rules or materials relating to the promotion.
4.2 In the rules of the promotion, or otherwise, you will not condition entry to the promotion upon taking any action on design3, for example, updating a status, posting on a profile or Page, or uploading a photo. You may, however, condition entry to the promotion upon becoming a fan of a Page.
Section 5. Indemnification
You will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) for any claim related to the promotion including without limitation the publicity or administration thereof.
Section 6. design3 Rights
6.1 We may modify these Promotion Guidelines at any time without notice to you. You will subject to the most current version of these Promotion Guidelines then in effect.
6.2 All decisions regarding promotions on design3 or using the design3 platform shall be determined by us in our sole discretion.
6.3 We reserve the right to review promotion rules and promotional copy at anytime but is under no obligation to do so. Our approval of rules or materials related to the promotion does not relieve you of any obligations in these Promotions Guidelines.
6.4 We may remove any materials related to a promotion at any time, regardless of whether the promotion was approved, where we determine the continued marketing or administration of such promotion may be unlawful under applicable laws, rules, regulations or guidelines or may cause unreasonable liability for us.
Please Note: You further acknowledge that compliance with these guidelines does not imply compliance with all applicable rules, regulations and laws. You are responsible for compliance with the foregoing and obtaining necessary counsel in connection therewith. In the event these Promotions Guidelines are inconsistent with the terms of the design3 Statement of Rights and Responsibilities, the terms of the Promotions Guidelines will control.
Below we have provided a few examples to help you understand how to apply Section 3 of the Promotion Guidelines:
You cannot: Condition entry in the promotion upon a user providing content on design3, such as making a post on a profile or Page, status comment or photo upload.
You can: Use a third party application to condition entry to the promotion upon a user providing content. For example, you may administer a photo contest whereby a user uploads a photo through a third-party application to enter the contest.
You cannot: Administer a promotion that users automatically enter by becoming a fan of your Page.
You can: Only allow fans of your Page to access the tab that contains the third-party application for the promotion.
You cannot: Notify winners through design3, such as through design3 messages, chat, or posts on profiles or Pages.
You can: Collect an address or email through the third-party application for the promotion in order to contact the winner by email or standard mail.
You cannot: Instruct people (in the rules or elsewhere) to sign up for a design3 account before they enter the promotion.
You can: Instruct users to visit the third-party application to enter the promotion (as described in Section 3.4(i)). Since users must have a design3 account in order to access an application on the design3 platform, if you give this instruction, they will be prompted to sign up for a design3 account if they do not already have one.

design3’s Privacy Policy

We want to earn your trust by being transparent about how design3 works. You should read this policy in its entirety, but should pay particular attention to these four highlights:
- design3 is designed to make it easy for you to share your information with anyone you want. You decide how much information you feel comfortable sharing on design3 and you control how it is distributed through your privacy settings. You should review the default privacy settings and change them if necessary to reflect your preferences. You should also consider your settings whenever you share information.
- design3 is not just a website. It is also a service for sharing your information on design3-enhanced applications and websites. You can also limit how your friends share your information with applications through your privacy settings.
- · Certain categories of information such as your name, profile photo, list of friends and pages you are a fan of, gender, geographic region, and networks you belong to are considered publicly available to everyone, including design3-enhanced applications, and therefore do not have privacy settings.
- design3 we will not share your information with advertisers without your consent. We allow advertisers to select characteristics of users they want to show their advertisements to and we use the information we have collected to serve those advertisements.
This policy contains eight sections, and you can jump to each by selecting the links below:
1. Introduction
Questions. If you have any questions or concerns about our privacy policy, contact our privacy team through this help page help. You may also contact us by mail at design3, 2450 17th Ave. STE #125, Santa Cruz, CA 95062.
Scope. This privacy policy covers all of design3. It does not, however, apply to entities that design3 does not own or control, such as design3-enhanced applications and websites. By using or accessing design3, you agree to our privacy practices outlined here.
No information from children under age 13. If you are under age 13, please do not attempt to register for design3 or provide any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. If you believe that we might have any information from a child under age 13, please contact us.
Parental participation. We strongly recommend that minors 13 years of age or older ask their parents for permission before sending any information about themselves to anyone over the Internet and we encourage parents to teach their children about safe internet use practices.
2. Information We Receive
Information you provide to us:
Personal information. When you sign up for design3 you provide us with your name, email, gender, and birth date. During the registration process we give you the opportunity to provide additional profile information, such as where you went to school and where you work, and to add a picture of yourself, to help your friends connect with you. In some cases we may ask for additional information for security reasons or to provide specific services to you. Once you register you can visit your profile at any time to add or remove personal information about yourself. You can add basic information about yourself, such as information about your hometown, family, relationships, and your political and religious views. You can also add other information about yourself including your activities, interests, contact information, as well as more information about your education and job history.
Content. One of the primary reasons people use design3 is to share content with others. Examples include when you update your status, upload or take a photo, upload or record a video, share a link, create an event or a group, make a comment, write something on someone’s Wall, write a note, or send someone a message. If you do not want us to store metadata associated with content you share on design3 (such as photos), please remove the metadata before uploading the content.
Transactional Information. We may retain the details of transactions or payments you make on design3. However, we will only keep your payment source account number with your consent.
Friend Information. We offer contact importer tools to help you upload your friends’ addresses so that you can find your friends on design3, and invite your contacts who do not have design3 accounts to join. If you give us your password to retrieve those contacts, we will not store your password after you have uploaded your contacts’ information.
Location Information. When you share your location with others or add a location to something you post, we treat that like any other content you post (for example, it is subject to your privacy settings). If we offer a service that supports this type of location sharing we will present you with an opt-in choice of whether you want to participate.
Information we collect when you interact with design3:
Site activity information. We keep track of the actions you take on design3, such as adding a friend, becoming a fan of a design3 Page, joining a group or an event, creating a photo album, sending a gift, poking another user, indicating you “like” a post, attending an event, or authorizing an application. In some cases you are also taking an action when you provide information or content to us. For example, if you share a video, in addition to storing the actual content you uploaded, we might log the fact you shared it.
Access Device and Browser Information. When you access design3 from a computer, mobile phone, or other device, we may collect information from that device about your browser type, location, and IP address, as well as the pages you visit.
Cookie Information. We use "cookies" (small pieces of data we store for an extended period of time on your computer, mobile phone, or other device) to make design3 easier to use, to make our advertising better, and to protect both you and design3. For example, we use them to store your login ID (but never your password) to make it easier for you to login whenever you come back to design3. We also use them to confirm that you are logged into design3, and to know when you are interacting with design3 platform applications and websites, our widgets and Share buttons, and our advertisements. You can remove or block cookies using the settings in your browser, but in some cases that may impact your ability to use design3.
Information from other websites. We may institute programs with advertising partners and other websites in which they share information with us:
- We may ask advertisers to tell us how our users responded to the ads we showed them (and for comparison purposes, how other users who didn’t see the ads acted on their site). This data sharing, commonly known as “conversion tracking,” helps us measure our advertising effectiveness and improve the quality of the advertisements you see.
- We may receive information about whether or not you’ve seen or interacted with certain ads on other sites in order to measure the effectiveness of those ads.
If in any of these cases we receive data that we do not already have, we will “anonymize” it within 180 days, meaning we will stop associating the information with any particular user. If we institute these programs, we will only use the information in the ways we explain in the “How We Use Your Information” section below.
Information from other users. We may collect information about you from other design3 users, such as when a friend tags you in a photo or video, provides friend details, or indicates a relationship with you. You can limit who can see that you have been tagged in a photo or video – which we refer to as photos or videos “of me” – in your privacy settings.
3. Information You Share With Third Parties
We take steps to ensure that others use information that you share on design3 in a manner consistent with your privacy settings, but we cannot guarantee that they will follow our rules. Read the following section to learn more about how you can protect yourself when you share information with third parties.
Sharing information on design3. We designed our privacy settings to enable you to control how you share your information on design3. You should review the default privacy settings to make sure they reflect your preferences. Here are some specific things to remember:
- You can control the visibility of most of the information you share on design3 through the privacy settings you select.
- Certain categories of information such as your name, profile photo, list of friends and pages you are a fan of, gender, geographic region, and networks you belong to are considered publicly available, and therefore do not have privacy settings. You can limit the ability of others to find this information on third party search engines through your search privacy settings.
- Some of the content you share and the actions you take will show up on your friends’ home pages and other pages they visit.
- Even after you remove information from your profile or delete your account, copies of that information may remain viewable elsewhere to the extent it has been shared with others, it was otherwise distributed pursuant to your privacy settings, or it was copied or stored by other users.
- You understand that information might be re-shared or copied by other users.
- Certain types of communications that you send to other users cannot be removed, such as messages.
- When you post information on another user’s profile or comment on another user’s post, that information will be subject to the other user’s privacy settings.
- If you use an external source to publish information to design3 (such as a mobile application or a Connect site), you should check the privacy setting for that post, as it is set by that external source.
“Everyone” Privacy Setting. Information set to “everyone” is publicly available information, may be accessed by everyone on the Internet (including people not logged into design3), is subject to indexing by third party search engines, may be associated with you outside of design3 (such as when you visit other sites on the internet), and may be imported and exported by us and others without privacy limitations. The default privacy setting for certain types of information you post on design3 is set to “everyone.” You can review and change the default settings in your privacy settings. If you delete “everyone” content that you posted on design3, we will remove it from your design3 profile, but have no control over its use outside of design3.
Exporting Information. You (and those you make your information available to) may use tools like RSS feeds, mobile phone address books, or copy and paste functions, to capture and export information from design3, including your information and information about you.
Advertisements. Sometimes the advertisers who present ads on design3 use technological methods to measure the effectiveness of their ads and to personalize advertising content. You may opt-out of the placement of cookies by many of these advertisers here. You may also use your browser cookie settings to limit or prevent the placement of cookies by advertising networks.
Links. When you click on links on design3 you may leave our site. We are not responsible for the privacy practices of other sites, and we encourage you to read their privacy statements.
4. How We Use Your Information
We use the information we collect to try to provide a safe, efficient, and customized experience. Here are some of the details on how we do that:
To manage the service. We use the information we collect to provide our services and features to you, to measure and improve those services and features, and to provide you with customer support. We use the information to prevent potentially illegal activities, and to enforce our Statement of Rights and Responsibilities. For example, we ask for your date of birth to verify that you are over age 13 and so that we can better limit your access to content and advertisements that are not age appropriate. We also use a variety of technological systems to detect and address anomalous activity and screen content to prevent abuse such as spam. These efforts may on occasion result in a temporary or permanent suspension or termination of some functions for some users.
To contact you. We may contact you with service-related announcements from time to time. You may opt out of all communications except essential updates on your account notifications page. We may include content you see on design3 in the emails we send to you.
To serve personalized advertising to you. We don’t share your information with advertisers without your consent. (An example of consent would be if you asked us to provide your shipping address to an advertiser to receive a free sample.) We allow advertisers to choose the characteristics of users who will see their advertisements and we may use any of the non-personally identifiable attributes we have collected (including information you may have decided not to show to other users, such as your birth year or other sensitive personal information or preferences) to select the appropriate audience for those advertisements. For example, we might use your interest in soccer to show you ads for soccer equipment, but we do not tell the soccer equipment company who you are. You can see the criteria advertisers may select by visiting our advertising page. Even though we do not share your information with advertisers without your consent, when you click on or otherwise interact with an advertisement there is a possibility that the advertiser may place a cookie in your browser and note that it meets the criteria they selected.
To serve social ads. We occasionally pair advertisements we serve with relevant information we have about you and your friends to make advertisements more interesting and more tailored to you and your friends. For example, if you become a fan of a Page, we may display your name and profile photo next to an advertisement for that Page that is displayed to your friends. We only share the personally identifiable information visible in the social ad with the friend who can see the ad. You can opt out of having your information used in social ads on this help page.
To supplement your profile. We may use information about you that we collect from other design3 users to supplement your profile (such as when you are tagged in a photo or mentioned in a status update). In such cases we generally allow you to direct how that information is shared in your privacy settings or give you the ability to remove the content (such as allowing you to remove a photo tag of you) or limit its visibility on design3.
To make Suggestions. We use your profile information, the addresses you import through our contact importers, and other relevant information, to help you connect with your friends, including making suggestions to you and other users that you connect with on design3. If you want to limit your visibility in suggestions we make to other people, you can adjust your search visibility privacy settings as you will only be visible in our suggestions to the extent you choose to be visible in public search listings. You may also block specific individual users from being suggested to you and you from being suggested to them.
Downloadable Software. Certain downloadable software applications and applets that we offer, such as our browser toolbars and photo uploaders, transmit data to us. We may not make a formal disclosure if we believe our collection of and use of the information is the obvious purpose of the application, such as the fact that we receive photos when you use our photo uploader. If we believe it is not obvious that we are collecting or using such information, we will make a disclosure to you the first time you provide the information to us so that you can decide whether you want to use that feature.
Memorializing Accounts. If we are notified that a user is deceased, we may memorialize the user’s account. In such cases we restrict profile access to confirmed friends, and allow friends and family to write on the user’s Wall in remembrance. We may close an account if we receive a formal request from the user’s next of kin or other proper legal request to do so.
5. How We Share Information
design3 is about sharing information with others — friends and people in your networks — while providing you with privacy settings that you can use to restrict other users from accessing your information. We share your information with third parties when we believe the sharing is permitted by you, reasonably necessary to offer our services, or when legally required to do so. For example:
When you make a payment. When you enter into transactions with others or make payments on design3, we will only share transaction information with those third parties necessary to complete the transaction and will require those third parties to agree to respect the privacy of your information.
When you invite a friend to join. When you ask us to invite a friend to join design3, we will send your friend a message on your behalf using your name. We may also send up to two reminders to them in your name. If your friend does not want us to keep their information, we will remove it at their request on this help page.
When you choose to share your information with marketers. You may choose to share information with marketers or electronic commerce providers that are not associated with design3 through on-site offers. This is entirely at your discretion and we will not provide your information to these marketers without your consent.
To help your friends find you. By default, we make certain information you have posted to your profile available in search results on design3 to help your friends find you. However, you can control who has access to this information, as well as who can find you in searches, through your privacy settings. We also partner with email and instant messaging providers to help their users identify which of their contacts are design3 users, so that we can promote design3 to those users.
To give search engines access to publicly available information. We generally limit search engines’ access to our site. We may allow them to access information set to the “everyone” setting and your public search listing (but you can turn off your public search listing in your privacy settings).
To help improve or promote our service. Sometimes we share aggregated information with third parties to help improve or promote our service. But we only do so in such a way that no individual user can be identified or linked to any specific action or information.
To provide you with services. We may provide information to service providers that help us bring you the services we offer. For example, we may use third parties to help host our website, send out email updates about design3, remove repetitive information from our user lists, process payments, or provide search results or links (including sponsored links). These service providers may have access to your personal information for use for a limited time, but when this occurs we implement reasonable contractual and technical protections to limit their use of that information to helping us provide the service.
To advertise our services. We may ask advertisers outside of design3 to display ads promoting our services. We may ask them to deliver those ads based on the presence of a cookie, but in doing so will not share any other information with the advertiser.
To offer joint services. We may provide services jointly with other companies, such as the classifieds service in the design3 Marketplace. If you use these services, we may share your information to facilitate that service. However, we will identify the partner and present the joint service provider’s privacy policy to you before you use that service.
To respond to legal requests and prevent harm. We may disclose information pursuant to subpoenas, court orders, or other requests (including criminal and civil matters) if we have a good faith belief that the response is required by law. This may include respecting requests from jurisdictions outside of the United States where we have a good faith belief that the response is required by law under the local laws in that jurisdiction, apply to users from that jurisdiction, and are consistent with generally accepted international standards. We may also share information when we have a good faith belief it is necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, or to protect ourselves and you from people violating our Statement of Rights and Responsibilities. This may include sharing information with other companies, lawyers, courts or other government entities.
Transfer in the Event of Sale or Change of Control. If the ownership of all or substantially all of our business changes, we may transfer your information to the new owner so that the service can continue to operate. In such a case, your information would remain subject to the promises made in any pre-existing Privacy Policy.
6. How You Can View, Change, or Remove Information
Viewing and editing your profile. You may change or delete your profile information at any time by going to your profile page and clicking “Edit My Profile.” Information will be updated immediately. While you cannot delete your date of birth, you can use the setting on the info tab of your profile information page to hide all or part of it from other users.
Delete uploaded contacts. If you use our contact importer to upload addresses, you can later delete the list on this help page.
Deactivating or deleting your account. If you want to stop using your account you may deactivate it or delete it. When you deactivate an account, no user will be able to see it, but it will not be deleted. We save your profile information (friends, photos, interests, etc.) in case you later decide to reactivate your account. Many users deactivate their accounts for temporary reasons and in doing so are asking us to maintain their information until they return to design3. You will still have the ability to reactivate your account and restore your profile in its entirety. When you delete an account, it is permanently deleted. You should only delete your account if you are certain you never want to reactivate it. You may deactivate your account on your account settings page or delete your account on this help page.
Limitations on removal. Even after you remove information from your profile or delete your account, copies of that information may remain viewable elsewhere to the extent it has been shared with others, it was otherwise distributed pursuant to your privacy settings, or it was copied or stored by other users. However, your name will no longer be associated with that information on design3. (For example, if you post something to another user’s profile, and then you delete your account, that post may remain, but be attributed to an “Anonymous design3 User.”) Additionally, we may retain certain information to prevent identity theft and other misconduct even if deletion has been requested.
Backup copies. Removed and deleted information may persist in backup copies for up to 90 days, but will not be available to others.
Non-user contact information. If a user provides your email address to us, and you are not a design3 user but you want us to delete your address, you can do so on this help page. However, that request will only apply to addresses we have at the time of the request and not to any addresses that users provide to us later.
7. How We Protect Information
We do our best to keep your information secure, but we need your help. For more detailed information about staying safe on design3, visit the design3 Security Page.
Steps we take to keep your information secure. We keep your account information on a secured server behind a firewall. When you enter sensitive information (such as credit card numbers and passwords), we encrypt that information using secure socket layer technology (SSL). We also use automated and social measures to enhance security, such as analyzing account behavior for fraudulent or otherwise anomalous behavior, may limit use of site features in response to possible signs of abuse, may remove inappropriate content or links to illegal content, and may suspend or disable accounts for violations of our Statement of Rights and Responsibilities.
Risks inherent in sharing information. Although we allow you to set privacy options that limit access to your information, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other users with whom you share your information. We cannot guarantee that only authorized persons will view your information. We cannot ensure that information you share on design3 will not become publicly available. We are not responsible for third party circumvention of any privacy settings or security measures on design3. You can reduce these risks by using common sense security practices such as choosing a strong password, using different passwords for different services, and using up to date antivirus software.

8. Other Terms
Consent to Collection and Processing in the United States. By using design3, you consent to having your personal data transferred to and processed in the United States.
Defined Terms. "Us," "we," "our," "platform" and "design3" mean the same as they do in the Statement of Rights and Responsibilities. “Information” and “content” are used more generally and interchangeably here than in the Statement of Rights and Responsibilities unless otherwise limited by the context.
